Attorneys in the Commonwealth of Massachusetts are subject to strict rules of professional conduct. The Board of Bar Overseers is appointed by the Supreme Judicial Court and is responsible for the discipline of attorneys who violate the Rules of Professional Conduct. The Board is made up of twelve volunteer members (eight attorneys and four members of the public). The General Counsel’s Office acts as legal counsel to the Board of Bar Overseers. They work with the volunteer members and attend pre-hearing conferences and hearings and draft reports from these events.
The Office of Bar Counsel is responsible for investigating complaints against attorneys. Complaints are often filed directly by the client, but the Office of Bar Counsel may learn of attorney misconduct through other sources, such as news reports or court decisions.
The Attorney and Consumer Assistance Program (ACAP) is part of the Office of Bar Counsel, and its role is to identify and attempt to resolve minor complaints without the need to formally docket a complaint.
